Abstract:	Der Beitrag untersucht die Vereinbarkeit aktueller nationaler Regelungen bezüglich Ausschreibung, Vergabe, Vertragsgestaltung und Vergütung von Planungsleistungen mit der Methode Building Information Modeling (BIM). Dabei werden Möglichkeiten der Ausgestaltung unter Berücksichtigung der herrschenden rechtlichen Rahmenbedingungen gegeben. Insbesondere wird aufgezeigt, welche Schwerpunktbereiche beachtet werden sollten und wie ein typischer BIM-Projektaufsatz ausgestaltet sein kann. Dabei wird auch auf Datenhoheit sowie Haftung und Verwertungsrechte eingegangen. Legal framework for the implementation of BIM The article examines the compatibility of current national regulations concerning the tendering, contracting and payment of design services using the method Building Information Modeling (BIM). Further, suggestions have been developed to take prevailing legal framework conditions in Germany into account. In particular, it is shown which topics should be considered from the beginning and how a typical BIM project approach can be structured. In addition, data integrity, liability as well as exploitation rights are discussed.
